It is proposed to submit for state consideration two legal decisions for persons already residing in the Republic of Armenia and who have confirmed a stable connection with the country: temporary citizenship both constitutional status and citizenship as faster legislative status.

Both decisions are aimed at strengthening people, families, businesses, tax base and professional competencies in Armenia. Statuses can be considered either as two independent options with the choice of one solution, or as a parallel double-circuit package of legal integration.

Review format

Temporary citizenship and citizenship are presented to the state as two independent statuses or as a single sequential model in which the faster legislative circuit is launched first and the constitutional status reinforces it at the next stage.

The initiative aims to ensure the legal stability of already integrated people and to consolidate their contribution to the economy and social life of Armenia.

Problem

Tens of thousands of relocants already live and work in Armenia, but remain in legal vulnerability: dependent on documents from the state of origin, face legal uncertainty and do not have a stable connection with Armenia.

Solution

Two statuses: temporary citizenship through a constitutional amendment and citizenship through a separate law based on a pre-existing special residence status.

How statuses can work

Independent statuses

The state considers temporary citizenship and citizenship as two independent solutions and chooses one main format for legal integration.

  • temporary citizenship is a stronger transitional status;
  • citizenship is a faster legislative mechanism;
  • each status can be submitted as a separate project.

Parallel two-circuit package

Citizenship is launched as the first practical circuit, and temporary citizenship is formalized as a subsequent strengthening in constitutional status.

  • quick start through the law;
  • gradual strengthening of legal ties with the state;
  • unified strategic integration architecture.

Main conclusion

For Armenia, there are two routes of different complexity and legal burden.

  1. Route A - temporary citizenship. This is a strong and politically clear model: after a minimum of 183 days of legal residence, a person receives temporary citizenship for a period of 3 years, the right to an Armenian document, free exit from Armenia and guaranteed return entry, protection of Armenia and the right to apply for full citizenship in a simplified manner. But since the current Constitution ties the right to vote to citizenship, such a model cannot be introduced by simple legislation without changing the Constitution.
  2. Route B is a special civilian affiliation. This is a new public legal status that is not citizenship, but provides almost the entire civil, social and economic scope of rights in Armenia. This model could be built on the already existing Armenian institution of special residence and special passport, but in the proposed package it is expanded and strengthened by the right to protection, guaranteed entry, judicial appeal and constitutional guarantees of status.

Which user requirements are fully included in the package?

By temporary citizenship

  • the right to apply after at least 6 months of legal residence in Armenia;
  • status period - 3 years;
  • the opportunity to apply for full citizenship within these 3 years;
  • Armenian temporary citizen document;
  • free exit from Armenia and guaranteed return entry;
  • the most complete set of civil rights;
  • the only political limitation in the project logic is participation in elections and referendums as a single constitutional bloc of political will;
  • constitutional guarantees of protection from extradition.

By nationality

  • “special citizenship of the Republic of Armenia” is introduced;
  • the legal regime is as close as possible to citizenship;
  • can be built on the already existing Armenian logic of special residence status and special passport;
  • gives the right to residence, work, entrepreneurship, banking and property legal capacity, education, healthcare, family reunification;
  • includes guaranteed entry into Armenia and enhanced legal protection;
  • serves as a bridge to full citizenship.

Legal basis

The current legal framework of Armenia, from which we build

Why a constitutional amendment is needed: The current Constitution of Armenia ties the right to vote and participate in a referendum to citizenship. At the same time, the current Constitution contains a clause on international treaties in matters of protection against extradition. That is why the draft includes not only a new status, but also a separate constitutional guarantee of protection.

What is already in the law of Armenia

  • general naturalization after three years of permanent residence and knowledge of the Armenian language and the Constitution;
  • the broad principle of equal rights of foreigners, unless otherwise established by the Constitution, laws or international treaties;
  • special residence status with a special Armenian passport and rights close to civil rights;
  • separate reliefs for citizens of EAEU states, including confirmation of legal residence without a work permit.

What doesn't exist yet

  • a separate category “temporary citizenship”;
  • the category of “civil affiliation” as a constitutionally protected connection with the state;
  • a constitutional guarantee of protection against extradition without reservation to international treaties;
  • special protected status specifically for relocants who have already integrated into Armenia, but depend on the documents of the state of origin.
